In general you are right, but then we don't need to discuss it. No one ever disputed, that Chruschtschoff gave Crimea to Ukraine, not even Putin, who rented  the naval station and hold this referendum. If Putin would not have recognized the legality, he could have refused paying the rent and just occupy it without a referendum.

Furthermore it was an internal matter not an international matter, when Chruschtschoff gave it to Ukraine.
