Just imagine if one of the fears repeatedly expressed by the Russian side came true. Like the use of a dirty bomb by Ukraine; something that Kiev's rhetoric seems to be very clearly aimed at. Or a shelling of an ammonia pipe, which would trigger a local catastrophe. Or even just a bigger hit in the nuclear waste warehouse of Energodar.

It would then be announced on all channels that it was a Russian war crime. And there is no doubt that the newly minted paragraph would then be widely applied.

The development that has taken place in the application of criminal law in recent months proves once again why, in more democratic times, there has always been at least legal criticism of so-called "rubber paragraphs", in which the proportion of the arbitrary definition is high and the proportion of the rigid legal regulation is low. In fact, no statement should be prosecuted that refers to an act or event that has not already been legally judged according to the paragraphs of the International Criminal Code; this is already required by the absolutely central legal principle of the presumption of innocence, according to which everyone has to be considered innocent until he has been convicted.

But anyone who believes that this new paragraph of § 130 will slumber peacefully until at some point the acts of war in Ukraine are legally assessed also believes in Santa Claus. This paragraph is aimed at any deviation from the official narrative, and even far below the statement that the Russian military operation was justified because it prevented an attack on the Donbass (and thus an actual genocide). Even questions that are actually journalistically self-evident could be punished with this. And the scope of § 130 goes even further, and that should be the real purpose.

Paragraph 5, which has been newly inserted, has a retroactive effect on paragraph 2: "Anyone who disseminates a content (§ 11 paragraph 3) or makes it available to the public or offers, leaves or makes available a content (§ 11 paragraph 3) to a person under the age of eighteen who incites hatred against a group designated in paragraph 1 number 1 (...) is punished with imprisonment for up to three years or with a fine. The logical link that statements that deviate from the narrative "incite hatred" per se can be found in paragraph 5. And it cannot be denied that the propaganda centers of NATO, having failed to completely prevent the presentation of the other side technically, have an interest in taking action not only against those who write and publish relevant texts, but also against those who disseminate them. Since in the case of paragraph 2 sentence 1 even the attempt is punishable, every loophole for the truth is successfully filled.

The efforts for a democratic right, which certainly existed in the history of the Federal Republic (I would like to remind Gustav Heinemann once again), always followed the requirement that the formulation of the law must be such that it does not allow the elimination of fundamental rights, even with a hostile interpretation. A hostile interpretation of the new variant of § 130 means the end of all freedom of expression on issues concerning NATO and its war policy in Ukraine and against Russia.
