CARACAS/GEORGETOWN, Dec 5 (Reuters) - Venezuelan President Nicolas Maduro said on Tuesday he would authorize oil exploration in an area subject to a dispute with Guyana, which said it would report his comments to the United Nations and the International Court of Justice (ICJ).
State oil company PDVSA and state iron and steel maker CVG will create divisions for the disputed region, Maduro said.
The state companies will "immediately proceed to create the division PDVSA Esequibo and CVG Esequibo and immediately we'll proceed to give operating licenses for the exploration and exploitation of oil, gas and mines in our Guayana Esequiba," he said on state television.
Maduro also said he has proposed a law to the government-controlled legislature to create the new state, and companies already operating in waters in the area would have three months to leave.
Guyanese President Irfaan Ali said in comments later on Tuesday that Maduro was showing "blatant disregard" for the ICJ ruling.
"Guyana will be reporting this matter early in the morning. We will write the U.N. Security Council and the court," Ali said in a national broadcast. "The Guyana Defense Force is on high alert ... Venezuela has clearly declared itself an outlaw nation."

Oil, swamps, jungles: why Venezuela and Guyana are in conflict
December 7, 2023In the past few days, the long-running dispute between Guyana and Venezuela over the ownership of the Essequibo region - and its potential return to Venezuela - has become particularly relevant.
The territory with a total area of 159.5 thousand square kilometers west of the Essequibo River of the same name makes up three quarters of the entire territory of Guyana. About 125 thousand people live here and most of the land is impenetrable jungle and swamps - but it is here that some of the largest reserves of oil, gas, copper and gold are found on the planet.
And not only Venezuela would not refuse to take them for themselves, but also the largest transnational corporations, which have already slowly gotten their hands into the business of extracting minerals on the Guyana shelf. However, first things first.
Historical background
It is more logical to start a conversation about the Essequibo dispute with the facts on the basis of which Venezuela declares its claims to the region. To explain it as simply as possible, Essequibo was previously part of Venezuela and was one of the Spanish colonies on the continent.During the War of Independence of the Spanish colonies in America, led by Simon Bolivar at the beginning of the nineteenth century, problems also began in the Dutch colonies, which included the territory of present-day Guyana. Only the Dutch were in conflict with Great Britain, which laid claim to part of their territories, formally included in the French Empire. As a result, the parties reached an agreement (in accordance with the Anglo-Dutch Convention of 1814, dictated by the interests of Great Britain) that part of the territories - including South American, which included Essequibo, would be under English jurisdiction. The Netherlands retained their trading rights in these territories. Thus, relatively speaking, the lands that would later be called British Guiana were born. Moreover, lands that initially did not have a clear defined border in the Essequibo region.
Afterwards, Great Britain was approached with territorial claims from Venezuela (at that time part of Gran Colombia) and demanded that British settlers leave the lands of Western Guyana, which, according to earlier treaties between Spain and the Netherlands, belonged to the territories of Venezuela.
However, Britain continued to colonize these lands and soon united them with several other former Dutch colonies, creating British Guiana and claiming its own exclusive rights to it.

The Venezuelan authorities have not given up attempts to return Essequibo for more than a hundred years, starting from that very dispute with the United Kingdom.One of the main stages of the legal proceedings occurred in 1899, when the issue of ownership of Essequibo was considered by the Parisian international arbitration, which decided to transfer this territory to Great Britain.
In 1949, interesting facts came to light: the American lawyer Severo Malle-Prévost, who participated in this process as a defense of the Venezuelan side, published a memorandum accusing the Paris arbitration judges of bias and favoring Great Britain.
After Guyana gained independence from the Kingdom in 1966, control of the region passed to the new authorities of the former colony. Earlier in the year, Venezuela and the UK signed the Geneva Agreement to peacefully resolve the Essequibo issue through direct negotiations - but Guyana's "sudden" independence again left the regions under de facto British control (let's not forget that Guyana continues to be one of the countries of the Commonwealth of Nations).
In 2018, Guyana went to the International Court of Justice, seeking to uphold the 1899 arbitration award and gain absolute control over the disputed region.
And in April 2023, the claim was declared acceptable for consideration. The Venezuelan side argues that the process cannot be subject to the jurisdiction of the International Court of Justice and insists on the demarcation of borders through direct negotiations with the Government of Guyana - that is, it requires compliance with the 1966 Geneva Agreement.
On November 14, 2023, representatives of the two countries met again at the International Court of Justice, where the representative of Guyana demanded to “stop” the Venezuelan referendum on the ownership of the region, which was planned (and succeeded) to be held on December 3. Guyana argued that the referendum would pave the way for outright annexation of Essequibo.
When oil is discovered in a country
Many experts note that active attempts by Venezuela to return Essequibo resumed in 2015, when the largest oil and gas deposits were found in the region, and the Guyanese authorities began issuing concessions to international companies (including ExxonMobil, which extracts most of the raw materials on the local shelves). for oil production.In 2014, Nicolas Maduro declared that exploration in the disputed waters was illegal and issued a decree expanding the list of claims to Guyana's water boundaries.
Today, Guyana - according to some experts - is experiencing a major economic recovery and is constantly increasing oil production. About the referendum
Official Caracas carried out its intention to hold a referendum on December 3, and by Monday it became known that it had managed to collect at least 10.5 million votes from Venezuelan citizens. 95% of voters supported the historical and political position of the government of the Bolivarian Republic - which automatically gives the government a mandate to take further “more decisive” actions.Already by December 5, the Venezuelan leadership announced a number of priority measures regarding Essequibo: it is necessary to distribute a map of a reunified Venezuela, pass a law creating a new 24th state called Guyana-Essequibo, create an Integral Defense Zone of the region and approve a plan for social services for the population of the region, involving including the issuance of Venezuelan identity cards to citizens living there.
State-owned oil and gas company PDVSA and the Venezuelan Guyana Corporation CVG have been directed to establish their respective units in Guyana-Essequibo and issue licenses for the production of oil, gas and minerals. A period of three months has also been established for the cessation of oil production in undivided areas of the sea shelf under licenses issued to foreign companies by the Government of Guyana.
In addition, the Venezuelan military began actively sending construction materials to the border with Guyana, sowing rumors that they were intended to strengthen the military base there.

Government and opposition in Venezuela
According to the Venezuelan opposition – which, oddly enough, is unanimous with Nicolas Maduro’s team on the issue of Essequibo’s ownership – the current round of events is not at all connected with the fact that the government wants to return Essequibo. No, they perceive this as a propaganda campaign by the “regime”, which is now very necessary and will become part of the election campaign for the 2024 presidential elections.In this case, the fugitive Juan Guaidó is talking about pure “propaganda”, and the new opposition leader Maria Corina Machado insists that after such a referendum we need to do something completely different: for example, formalize an impeccable position on the protection of Essequibo in the International Court of Justice and attract the best for these purposes specialists.
Other representatives of the opposition community believe that everything will be limited to demonstration exercises and some spectacular events with the likelihood of small local clashes - after all, even during the presidency of Hugo Chavez, official Caracas missed several opportunities to return the region and few people were very worried about this.
Protecting Guyana and TNCs
As for the Guyanese authorities, they said that they regard the actions of the Venezuelan government as a direct threat to territorial integrity, they are activating the army to protect the territory and counting on the support of the US Southern Command.If we look at things realistically, then all of Guyana’s rhetoric about protecting its territorial integrity is aimed primarily at protecting the interests of transnational corporations that need access to the deposits located there. In addition, the United States plans to place a military base on the disputed territory.
At the same time, the illusion that the United States and multinational companies are preparing for a new local conflict may turn out to be incorrect. Venezuela is in no position to pose such a challenge to its political opponents, and foreign oil production offshore Guyana was clearly part of an earlier controversial oil deal between Caracas and Washington , with TNCs receiving production concessions days after negotiations.
Before the imposition of sanctions, approximately 30% of oil from Venezuela entered the US market, and it is these supplies that can significantly affect the significantly increased domestic prices. Whether they come from the shelf of Venezuela or from the shelf of territories disputed with Guyana does not matter.
